Terms of Service
These Terms of Service govern all work performed by our company. By engaging our services you agree to the following terms.
1. Scope of Services
We provide civil construction services including excavation, road works, utilities, drainage, pavements, structures and related project activities. The scope of each engagement is confirmed in a written proposal or contract.
2. Client Obligations
Clients must:
- Provide accurate project information and required documentation
- Ensure site access at agreed times
- Comply with all relevant laws and approvals
- Notify us promptly of site issues or hazards
- Cooperate with our team to support safe and efficient delivery
3. Variations
Any change to the agreed scope of work will be treated as a variation. Variations may affect cost and project timelines. All variations must be approved in writing before work proceeds.
4. Pricing and Payment
Pricing is set out in the proposal or contract. Payment terms apply as stated. Late payment may result in suspension of works and additional charges. Ownership of materials may remain with us until full payment is received.
5. Work Health and Safety
We maintain strict compliance with Work Health and Safety laws in New South Wales. All site participants must follow our safety procedures and instructions at all times.
6. Environmental Management
We comply with all environmental obligations and expect clients to support environmentally responsible operations on every project.
7. Delays and Site Conditions
We are not liable for delays caused by weather, latent conditions, third party actions or events outside our control. Additional costs arising from such events may be chargeable.
8. Liability
To the maximum extent permitted by law our liability is limited to the resupply of services or the cost of resupply. We are not responsible for indirect or consequential loss.
9. Insurance
We maintain appropriate insurance including public liability, workers compensation and contract works insurance. Evidence of cover is available on request.
10. Termination
Either party may terminate the agreement in accordance with the contract. The client must pay for all work performed up to the termination date including authorised variations.
11. Intellectual Property
All drawings, methodologies, reports and related materials created by us remain our intellectual property unless otherwise agreed in writing.
12. Governing Law
These Terms of Service are governed by the laws of New South Wales. Any disputes will be resolved in the courts of New South Wales.
